                                 ORDER

Bail Application No.5889 of 2009 is filed by Babu George and

Sebastian George while Bail Application No.5854 of 2009 is filed by

James George and Shibu George. They apprehend arrest on an

accusation of having committed non bailable offence in Crime

No.271 of 2008 of Santhanpara Police Station.

2. The learned Public Prosecutor submitted that an extent of

14 acres, which according to the Government, was unauthorisedly

in the possession of the petitioners were taken possession by the

Government. In Crime No.271 of 2008, the petitioners are not

accused persons. There is no intention to arrest them. This

submission is recorded and the Bail Applications are closed.

3. It is also submitted by the learned Public Prosecutor that if

during the course of investigation, it is revealed that the petitioners

are involved in the offence, then only the investigating agency

would proceed against the petitioners. This submission is recorded,

leaving open the right of the petitioners to approach this Court

again as and when occasion arises.
