Rule.

Mr.L.R. Pujari, learned Additional Public Prosecutor, waives service
of Rule.

The
applicant-convict through his wife, who is appearing as
party-in-person, has preferred the present application for temporary
bail on the ground that his mother is suffering from Paralysis and
Diabetes and, therefore, for her treatment, presence of the
applicant-convict is required.

Medical
papers are produced and it appears that ground is genuine. Jail
record shows that earlier
the applicant-convict was released on temporary bail as well as on
furlough and he has surrendered in time. Hence, considering the
facts and circumstances, applicant-convict be released on temporary
bail for a period of 10 (Ten) days on a personal bond of Rs.5,000/-
(Rupees Five Thousand Only) with the further direction that upon
expiry of the period, he shall surrender with the Jail Authority.
Rule is made absolute to the aforesaid extent.

Service is permitted, today.
