1. Mr.V.A.Mansuri
for Mr. Hakim states that respondent no.1 – driver has expired
and therefore he may be permitted to be deleted in the present
application as well as in the First Appeal.

2. Permission
granted. Respondent no.1 shall stand deleted.

3. The
present application is for condonation of delay of 44 days in
preferring appeal against the judgment and the award passed by the
Tribunal in M.A.C.P. No. 27 of 1991.

4. Respondent
no.2 is served. None appears on his behalf. For respondent no.3, Mr.
Mehta appears.

5. Considering
the facts and circumstances and in view of the grounds stated in the
application for condonation of delay, sufficient cause is made out.
Hence, delay deserves to be condoned and therefore condoned.
Application is allowed to the aforesaid extent. Rule made absolute
accordingly.
