1. Mr.
T.S. Nanavati, learned counsel for the respondent, has supplied the
copies of the communication dated 29.07.2010 of the Chief Officer
respondent no.1-Nagar Palika along with the cheque dated 29.07.2010
of Dena Bank for Rs.17,176/- being the amount of Gratuity payable to
the deceased-original petitioner. He has handed over the said cheque
to Mr. D.R. Dave, learned counsel for the petitioner, before this
Court today, which has been duly accepted.
2. In
view of the above, no further orders are required to be passed in the
matter. The said payment of Rs.17,176/- is towards full and final
settlement of all the dues of the petitioner. It is, however, made
clear that the Court has not gone into the question of grant of
pension to the legal heirs of the deceased-original petitioner, in
this petition.
3. Consequently,
the petition stands disposed of. Rule is discharged. Interim relief,
if any, stands vacated. The copies of the said communication dated
29.07.2010 and cheque of Rs.17,176/- are taken on record.
