Heard learned counsel for the petitioner,
learned Additional Public Prosecutor for the State and Sri
Sudhir Kumar Bijpuri, for opposite party no.2.
This is an application under Section 482 of the
Code of Criminal Procedure seeking quashing of order dated
31.07.2007 passed in Complaint Case no. 927 ( C ) of 2001
by Judicial Magistrate, Patna, refusing to discharge and order
dated 25.2.2009 passed in Cr.Rev. no. 701 of 2007 by
Additional Sessions Judge, 4th, Patna, affirming such refusal.
It is submitted that between the parties there
were altogether twenty cases of similar nature and vide order
dated 20.01.2010 in altogether nine cases were disposed of on
the basis of compromise and final payment between the
parties. Remaining ten cases have also been disposed of in

same way by orders dated 16.02.2010 and 15.11.2010.
In the instant case also full payment has been
made and parties have left with no reason to proceed further
with the case pending before the court below. Accordingly,
the impugned order is quashed.
This application stands disposed of.
