The present petition was filed under Section 482 Cr.P.C.

seeking quashing of complaint under Sections 323, 341, 506, 148, and

149 IPC and Sections 3 & 4 of the Scheduled Caste & Scheduled Tribe

(Prevention of Atrocities) Act, 1989. In the present case, quashing of

summoning order (Annexure P2) was also sought. The petition was

listed for motion hearing on 28.7.2006.

Noticing the contention of the petitioners, the proceedings

were not stayed, however, arrest of the petitioners was stayed subject to

condition that they shall furnish their regular bail bonds to the

satisfaction of the Court.

Mr. Dinesh Goyal, Advocate, appearing for the petitioners

stated that orders passed by a Co-ordinate Bench on 28.7.2006 had

been complied with. Petitioners had appeared before the trial Court and

their regular bail bonds were accepted.

Mr. P.S. Sekhon, Advocate, appearing for the respondent

states that during the pendency of petition, charge has been framed and

trial is in progress.

At this stage, counsel for the petitioner states that he be

permitted to withdraw the present petition to raise all arguments before

the trial Court at appropriate stage.

In view of the peculiar facts of the case, interim order dated

28.7.2006 passed by this Court whereby the petitioners were allowed to

furnish regular bail bonds is affirmed till conclusion of trial.

As prayed, the present petition is dismissed as withdrawn with

liberty as prayed for.
