Heard the learned counsel for the applicant and the learned A.G.A.

It is contended by the learned counsel for the applicant that in the present case
no notice has been served to the applicant even date of service of notice has
not been mentioned in the complaint.

Issue notice to O.P. 2 returnable within a period of four weeks.

In view of the submissions made by the learned counsel for the applicant and
the learned A.G.A. further proceedings in complaint case no. 83 of 2009
under section 138 N.I. Act P.S. Swaroop Nagar district Kanpur Nagar pending
in the court of M.M. IVth Kanpur Nagar shall remain stayed till the next date
of listing.

List after four weeks for orders.
