02/ 29.07.2011 Heard learned counsel for the petitioner and the

State.

2. Petitioner is a constable serving in the

Vaishali District Police. He has filed the writ petition

questioning the District Order No. 2611/05 passed by the

Superintendent of Police, Vaishali at Hajipur bearing

Memo No. 5308 dated 29.11.2005, Annexure-1

whereunder he has been punished with stoppage of one

increment which is akin to two black marks affecting his

service career throughout. Against the aforesaid

punishment order dated 29.11.2005, Annexure-1,

petitioner has filed appeal before the D.I.G., Tirhut Range,

Muzaffarpur, which according to the petitioner, is still

pending.

3. Let the D.I.G., Tirhut Range, Muzaffarpur

consider and dispose of the appeal of the petitioner ( if not

already disposed of) as early as possible in any case within

two months from the date of receipt/ production of a copy

of this order before the D.I.G., Tirhut Range, Muzaffarpur.

4. The writ petition is, accordingly, disposed of.
