Learned
advocate Mr. Murali N. Devnani seeks permission to withdraw the
present petition with a view to file representation to the respondent
No.1 regarding the transfer outside the circle. Learned advocate has
stated that for the first time, deviation has been made from the
policy regarding transfer as well as transfer on promotion.
Therefore, he has stated that his client would make a detailed
representation with a request to consider his case for posting
anywhere within the circle i.e. within Gujarat when there are
vacancies available.
In
the facts and circumstances, permission as prayed for is granted. It
goes without saying that the representation made by the petitioner
shall be decided by the respondent No.1 in accordance with law on
merits. While considering the representation, respondent No.1 shall
also consider the aspect about the consistent policy and any
deviation made by the Bank and also shall consider sympathetically
the possibility of accommodating the petitioner within Gujarat
circle. The petitioner shall make representation within 15 days and
the same shall be considered thereafter within 15 days. Accordingly,
present petition is disposed of.
