ORDER
This is a petition filed under Section 439 of Criminal
Procedure Code seeking bail.
2. Petitioner is accused in Crime No. 67/2008 of
Kayamkulam Excise Range for the offence punishable under Sections 8
(1), (2) and 55(g) of the Abkari Act.
3. The facts are stated in the order of the court below,
which is appended to this petition. Considering the quantity involved
and also the fact that a good part of the investigation is over, bail needs
to be granted.
The application is allowed as follows:
1) Petitioner shall be released on bail on his executing a
bond for Rs.10,000/- (Rupees Ten thousand only) with two solvent
sureties for the like sum each to the satisfaction of JFCM concerned.
2) Petitioner shall not tamper or attempt to tamper with the
evidence or influence or try to influence the witnesses.
