Challenge in the writ petition is against Ext.P11 final
gradation list of Upper Division Clerks in the Department of
Homoeopathy, who were promoted after 01/10/1997.
2. The petitioner’s case is that against Ext.P8 provisional
gradation list, objections were invited by Ext.P9 pursuant to claims
raised by the 4th respondent, and that she filed Ext.P10 objection,
which was not considered while finalising the gradation list.
3. Since Ext.P11 gradation list is dated 14/11/2008, the
case was adjourned with a direction to the learned Government
Pleader to obtain instructions in the matter. Today, on instructions,
she submits that an appeal filed by the petitioner against Ext.P11 is
pending consideration of the Government. At this stage, the
learned counsel for the petitioner points out that, what is described
by the learned Government Pleader as appeal, is Ext.P10, which was
filed by the petitioner before the 3rd respondent and now forwarded

by the 3rd respondent to the 1st respondent.
Be that as it may, as according to the learned Government
Pleader, an appeal preferred by the petitioner against the gradation
list is pending consideration of the 1st respondent, it is directed that
the 1st respondent shall consider the said appeal, whether it is
Ext.P10 or not, with notice to the petitioner and other affected
parties. This shall be done as expeditiously as possible, at any rate,
within three months of production of a copy of this judgment, along
with a copy of this writ petition.
This writ petition is disposed of as above.
