ORDER

1. By
way of this petition under Article 226 of the Constitution of India,
the petitioner has prayed for an appropriate writ, order and/or
direction, directing respondent No.1 to recover an amount of
Rs.2,69,767/- as per Recovery Certificate dated 29/01/2010 from
respondent Nos.2 to 4.

2. Mr.R.D.Raval,
learned advocate appearing on behalf of the petitioner has stated
that to the best of his knowledge and information, Recovery
Certificate, which is sought to be implemented came to be challenged
by the Corporation before this Court and this Court has directed the
Corporation to deposit the amount of Recovery Certificate and go for
review application. In view of the above, he does not press the
present petition at this stage with a liberty to revive the present
petition if the aforesaid is found to be incorrect.

3. Permission
is accordingly granted. The present petition is dismissed as not
pressed with above liberty. No cost.
