ORDER

Learned
counsel for the petitioner seeks permission to delete certain portion
from the petition. Permission is granted.

He
also sought permission to join original accused as party respondents.
Permission is granted.

To
substantiate averments made in the petition that accused were
previously delaying the trial and as soon as trial was transferred
from Gondal to Rajkot, they showed keen interest to proceed further,
counsel shall also produce copy of complete rojkam of the trial so
far.

Counsel
for the petitioner submitted that trial was transferred from Gondal
to Rajkot without any previous notice to the petitioner who is
original complainant. His representations to the learned Principal
Sessions Judge as well as High Court were turned down. Issue notice
returnable on 13.9.2010. Learned APP Mr. Kartik Pandya waives service
of notice for respondent no.1.

Direct
service to respondents no. 2 to 4 is permitted. Additional
respondents original accused be served through concerned police
station.

At
this stage and till then, it is clarified that there is no stay
against the trial.
