Rule.

Learned A.P.P. Mr.A.J. Desai waives service of rule on behalf of the
respondents.

Heard
learned counsel appearing for the respective parties.

This
application has been filed by the applicant for fixing the date of
final hearing of the Criminal Appeal of the year 2001.

Learned
counsel for the applicant, Mr.Unwalla has argued that appeal of the
applicant is of the year 2001 and the applicant has already
undergone more than eight years of sentence. It is, therefore,
requested that the appeal may be fixed for final hearing.

We
have gone through the application and the arguments advanced by the
learned counsel for the applicant. At present, we are having only
one bench dealing with the criminal matters and, therefore, we are
not in a position to give priority to the present applicant.

However,
looking to the facts and circumstances of the case, appeal of the
applicant is required to be listed on the final hearing board.
Hence, office is directed to list Criminal Appeal of the applicant
on the final hearing board in the week commencing from July, 2009.

With
this observation and direction, this application stands disposed of.
Rule is discharged.
