Heard
learned advocate Mr.Bipin I. Mehta appearing on behalf of applicant.
On last occasion, on 29.11.2010, matter was adjourned because
learned advocate Mr.R.B.Joshi has not remained present, even though,
request was made by learned advocate Mr.Mehta that learned advocate
Mr.Joshi is coming from Bhavnagar, therefore, matter was adjourned
with a clarification that if learned advocate Mr.Joshi will not
remain present on 02.12.2010, then this Court will proceed further
in absence of learned advcoate Mr.Joshi.

Today,
learned advocate Mr.Joshi has not remained present, therefore, I
have considered submissions made by learned advocate Mr.Mehta and
also perused judgment and decree passed by Courts below. According
to my opinion question involved and raised in present application,
requires detailed examination. Hence, Rule.

Learned
advocate Mr.Mehta made a statement before this Court that at present
applicant is in possession of suit premises, therefore, it is
directed to opponent not to disturb possession of applicant in
respect to suit premises, provided that applicant must have to pay
regular and due monthly amount of rent to opponent.
