                   W.P.(C) NO. 37317 OF 2010
                 =====================

Petitioners who are students of the 2nd respondent College

wants to appear for the 10th Semester examination. Admittedly,

they have not passed all examinations upto 6th semester

examination. It is therefore that the University is refusing to

permit the petitioners to appear for the final examination.

2. Admittedly, University Rules provides that students

should pass all examinations upto 6th Semester to be eligible to

appear for the 10th Semester examination and the petitioners do

not satisfy this condition. If that be so, petitioners cannot aspire to

appear for the 10th semester examination and this Court will not

be justified in issuing such a direction. Further, this view has

already been taken by this Court in the judgment in WP(C)

No.36563/10.

Writ petition is dismissed.
