The petitioner is the mother of a child by name Halmo. J. The

names of the child as well as the parents have been wrongly entered

in the birth register. The name of the child is shown as Abaty. J.

Jude. The name of the father is shown as Jood. R. The name of the

mother is shown as Jesso Jood. The father of the child is Jayan A.R.

although his pet name is Jude. The mother of the child is Jesso. G. It

has been entered as Jesso Jood in the birth register. The petitioner

seeks appropriate correction in the birth register and issue of a

corrected birth certificate. The petitioner’s grievance is that the 2nd

respondent is insisting on an order of this Court for considering her

application.

2. I have heard counsel for the 1st respondent also, who does

not dispute the fact that as per the decision of this Court in

Varghese v. Director of Panchayat, 2008(2) KLT 278, such

corrections can be made.

3. In the above circumstances, the writ petition is disposed of

with a direction to the 1st respondent to consider and pass appropriate

orders on the application for correction of the birth register submitted

by the petitioner in accordance with the dictum laid down in

Varghese’s case (supra) as expeditiously as possible, at any rate,

within one month from the date of receipt of a copy of this judgment.
