Heard leaned counsel for the applicant, learned AGA and perused the record.
Counsel for the applicant submitted that in view of the allegation the matter is
purely of civil nature. In criminal misc. application no. 26924 of 2009
(Mahendra Kumar Jain Vs. State of U.P. and another) and 26925 of 2009
(O.P. Tiwari Vs. State of U.P.). The proceedings have already been stayed.
Issue notice to opposite party no. 2 returnable at an early date.
Till the next date of listing, further proceeding against the applicant in case
no. 900 of 2008, (State Vs. Rakesh and other) under Sections 420, 467, 468,
471 IPC, P.S. New Agra, District-Agra, shall remain stayed.
List along with criminal misc. application nos. 26924 of 2009 and 26925 of
2009.
