2. 20.9.2010 Learned counsel for the petitioner seeks permission to

make some corrections in the prayer portion of the bail petition of

Cr. Misc. no.24753 of 2010.

Permission is granted.

Heard learned counsel for the petitioners, informant and

the State.

There is counter version of the case by filing Dinara P.S.

case no.83 of 2010 that informant party brutally assaulted accused

persons having fractured injuries also while they are alleged for

coming with these petitioners on a truck tried to crush all the three

motor-cycles and its riders with intention to kill but they jumped

from their motor-cycles and could save themselves from having

injuries. Petitioner of Cr. Misc. no.24753 of 2010 is alleged for

causing firing but with no injuries. Land dispute is there in between

the parties. Apparently appears more fault at informant parties hand

entitling petitioner for anticipatory bail.

Having regard to the facts and circumstances of the case,

in the event of arrest or surrender within a period of one month from

date of receipt/production of a copy of this order, above named

petitioners of both petitions shall be released on bail on furnishing

bail bond of Rs.10,000/- each with two sureties of the like amount

each to the satisfaction of the S.D.J.M., Bikramganj, Rohtas, in

connection with Dinara P.S. case no.81 of 2010 subject to the

conditions as laid down under section 438(2) of the Code of

Criminal Procedure.
