8. 31.03.2011 By order dated 17.3.2010 a report was called for
from the Superintendent of Police, Sheohar as to whether the
appellant Nos. 1 and 2 of Cr. Appeal No. 868 of 2007(DB),
namely, Snehi Rai son of Late Khelawan Rai and Ram Faresh
Rai son of Late Braj Nandan Rai, both resident of village- Tulsi
Nagar, P.S. Tariyani, District- Sheohar are alive or not. Now the
report received from the office of Superintendent of Police,
Sheohar dated 4.5.2010 discloses that both the aforesaid
appellants are dead.
In view of death of appellant Nos. 1 and 2 of Cr.
Appeal No. 868 of 2007 (DB) the appeal preferred by them is
held to have abated and their appeals are disposed off
accordingly. However, the said Cr. Appeal no. 868 of 2007 shall
be heard and decided in respect of appellant Nos. 3 and 4,
namely, Kishori Rai and Mauje Rai.
