 4/14.03.2011

The petitioner is an accused in the case registered for the offence under
sections 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the petitioner has been
falsely implicated in the case as there was litigation and enmity between the
informant’s family and the petitioner’s family; the only allegation against the
petitioner is that he along with others had called and took the deceased with
them; there is no other cogent material against him; the informant is the
accused in the murder case of the petitioner’s father being Manatu P.S. Case
no.25/10, which is still pending; petitioner is an intermediate student; he is in
custody since August,2010; petitioner is a local permanent resident; there is no
chance of his absconding.

Learned APP opposed the prayer for bail of the petitioner, but, after going
through the case diary, has not disputed the said contentions of learned counsel
for the petitioner.

Regard being had to the facts and circumstances of the case, the above
named petitioner is directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
satisfaction of learned Chief Judicial Magistrate, Palamau at Daltonganj in
connection with Manatu P.S. case no.22 of 2010, corresponding to G.R. Case
no.976 of 2010.
