2 13-10-2011 Heard the parties.

The petitioner apprehends his arrest in a criminal
prosecution registered under Sections 366(A), 376/ 34 of the
Indian Penal Code.

According to the prosecution case, one Sangita Kumari,
aged about 13 years, a student of Class-VIII, was taken to Delhi
and was sexually assaulted by the accused persons, specially co-
accused Damodar Ram and Suresh Ram. The petitioner is also
named in the F.I.R. as an accused and is alleged to have been
instrumental in commission of the crime in question. In her
statement under Section 164 Cr. P.C. the minor victim girl has
fully supported the prosecution case.

In view of serious nature of allegation in the F.I.R., vide
Annexure1, this Court is not inclined to accede to the prayer made
on behalf of the petitioner for grant of anticipatory bail. It is,
accordingly, rejected.

The petitioner must surrender in the court below within a
period of four weeks from today in connection with Rajpur P.S.

Case No. 107 of 2010, arising out of Complaint Case No. 813 ( C )
of 2010, pending in the court of learned Chief Judicial Magistrate,
Buxar and, if so advised, seek regular bail which shall be
considered on its own merit, without being prejudiced by the
present order.
