ORAL
ORDER

1. Shri
Mangukiya, learned advocate appearing on behalf of the petitioners is
permitted to circulate the petition today looking to the urgency
shown and in fact as the same was mentioned at the residence
yesterday.

2. Shri
Mangukiya, learned advocate appearing on behalf of the petitioners
has made a grievance that by not considering the Revision Application
preferred by the petitioners before the Gujarat State Cooperative
Tribunal against the interim order passed by the learned Board of
Nominees and keeping the hearing of the application/interim relief in
Revision Application at 3:00 p.m. today, virtually the Revision
Application preferred by the petitioners would become infructuous.

3. Under
the circumstances, without further entering into the merits of the
case and without expressing anything on merits, the learned tribunal
is hereby directed to hear the interim relief application submitted
by the petitioners in Revision Application No. 132/2010, which has
been filed against the interim order passed by the learned Board of
Nominees, today itself after giving an opportunity to all the
concerned and pass an appropriate interim order in accordance with
law on its own merits at the earliest.

4. With
this, the present Special Civil Application is disposed of.

Direct
service is permitted.

(M.R. SHAH, J.)
