                                          O R D E R

Petitioner who is the 3rd accused in Crime No.1598/06 of Central

Police Station, Ernakulam for offences punishable under sections 3 to 5

and 7 of the Immoral Traffic (Prevention) Act, 1956, seeks anticipatory

bail.

2. The learned Public Prosecutor opposed the application.

3. The case of the prosecution is that on 28.11.2006 at about

5.25 PM accused 1 and 2 were found naked in the room inside the Parlour

of which the 3rd accused (petitioner herein) is the licencee and were seen

indulging in sexual activities in a completely nude position. The first

accused was the customer and the second accused is a lady ostensibly

employed as a Therapist.

4. Anticipatory bail cannot be granted in a case of this nature.

There is no reason why the petitioner should not surrender before the

Magistrate concerned and seek regular bail. Accordingly, if the

petitioner surrenders before the Magistrate concerned and files an

application for regular bail, within 10 days from today, the same shall be

considered and disposed of, preferably on the same date on which it is

filed.

With this direction, this petition is disposed of.
