JUDGMENT

1. This
Special Civil Application is filed against the order dated 1.6.1994
passed by the learned Extra Assistant Judge, Junagadh in Civil
Misc.Appeal No.60 of 1994 dismissing the appeal against the order
dated 10.2.1994 passed by the learned Civil Judge (Senior Division),
Junagadh below Exh.6 in Regular Civil Suit No.884 of 1993 dismissing
the application for temporary injunction.

2. Learned
advocate Mr.Premal Joshi for the petitioner, upon instructions,
states that during the pendency of this petition, the main Regular
Civil Suit No.884 of 1993 has been disposed of finally and,
therefore, this petition against the interim order in that suit will
not survive and will become infructuous.

3. Upon
the statement made by learned advocate for the petitioner, this
petition stands disposed of as having become infructuous. Petition
stands disposed of accordingly. Rule is discharged. Liberty granted
to the petitioner to revive the petition in case of any difficulty.
