Heard learned counsel for the applicant, Sri Gaurav Kakkar for the
complainant, learned AGA for the State and perused the record.

It is contended by the learned counsel for applicant that as per FIR
version, the accused persons came at the spot and fired shots.
During the course of investigation, specific weapon has been
assigned and the applicant was shown armed with contry made
pistol and the injuries sustained by the deceased cannot said to be
caused by the applicant.

Learned AGA and private counsel for the complainant contended
that the applicant and co-accused have fired shots and committed
the murder of the deceased by causing ante-mortem injuries.

Considering the facts and circumstances of the case but without
expressing any opinion on the merits of the case, I do not find any
merit in the bail application.

Consequently, the prayer for bail of the applicant Juned is hereby
rejected at this stage.
