ORDER

1. This
matter has come time and again before this Court. Mr. Bavishi has
consistently not remained present. Last time i.e. on 12.08.2008,
this Court passed the following order:

Mr.

Bavishi has filed sick note. As a last chance S.O. To 26th
August 2008. If on the next Mr. Bavishi will not be able to attend
the matter, he shall make alternative arrangement, failing which the
matter shall be taken up and decided on merits in his absence.

2. In
spite of the aforesaid order, Mr. Bavishi is not present in the court
today. In that view of the matter, appeal is dismissed for default.
No order as

to
costs.
