                              ORDER

The petitioner filed M.C.No.226/08 against the respondent

before the Family Court, Palakkad claiming maintenance. After

the petitioner filed the maintenance case, the respondent

(husband) filed O.P.No.704/08 before the Family Court,

Malappuram, against the petitioner, for restitution of conjugal

rights. Both these cases are pending. The petitioner is residing

at Kongad in Palakkad District. It is stated that the respondent is

working at Coimbatore. It is stated that even if the case pending

before the Family Court, Malappuram is transferred to Palakkad,

the respondent would not be put to prejudice and in fact, it

would also suit his convenience. The petitioner has to maintain a

minor girl aged only one year. It is difficult for her to travel to

Malappuram and to attend the Family Court, Malappuram, says

the petitioner.

2. In the facts and circumstances of the case,

O.P.No.704/08 pending before the Family Court, Malappuram

TPC No.231 /2008 2

shall stand transferred to the Family Court, Palakkad. The

Registry shall send a copy of the order to the Family Court

Malappuram and the Family Court, Palakkad.

The Transfer Petition is allowed accordingly.
