2 19/07/2011 Learned Counsel for the petitioners submits
that the petitioners 1 and 2 are the step-uncles
(CHACHA). It is submitted that it has come during the
investigation that there was a partition in the year 1992
and that these petitioners live in Patna and therefore,
they could not be responsible for the offences alleged to
have been committed under Section 304B of the Indian
Penal Code.
Call for the photocopy of the original case diary
of Hajipur Town Police Station Case No. 357 of 2007 from
the Court of the Chief Judicial Magistrate, Hajipur at
Vaishali.
Issue notice to Opposite Party No. 2 both by
ordinary process and under registered post, requisites
etc. for which must be filed within a period of ten days
from today, failing which this application shall stand
rejected without further reference to a Bench.
List this case on appearance of Opposite Party
No. 2.
In the mean time, further proceedings of the

aforesaid case shall remain stayed.
