This
petition, under Article 226 of the Constitution of India, has been
filed with the following prayers:
(A) admit
this petition;
(B) issue
appropriate writ, order or direction directing the concerned
respondent authorities to decide the representation dated 13/7/2010
with regard to rectification of erroneous dates considered by the
concerned respondent authorities while extending 1st and
2nd Higher Pay Scales to the petitioner, pursuant to the
order passed by this Hon’ble Court dt.22/3/2010 in Special Civil
Application No.1197/2010 as expeditiously as possible in the
aforesaid peculiar facts and circumstances of the case;
(C) pending
admission and final disposal of this petition, be pleased to issue
appropriate writ, order or direction directing the concerned
respondent authorities to decide the representation dated 13/7/2010
with regard to rectification of erroneous dates considered by the
concerned respondent authorities while extending 1st and
2nd Higher Pay Scales to the petitioner, pursuant to the
order passed by this Hon’ble Court dt.22/3/2010 in Special Civil
Application No.1197/2010 as expeditiously as possible;”
Mr.N.K.Majmudar,
learned advocate for the petitioner, has submitted that pursuant to
order dated 22.03.2010 passed in Special Civil Application No.1197 of
2010, the petitioner had made a representation to the competent
authorities to decide the representation of the petitioner, in
accordance with law. However, this representation has not been
decided till date. It is stated by Mr.N.K.Majmudar, learned counsel
for the petitioner, that the interest of justice would be met, if
respondent No.2 is directed to consider and decide representation
dated 13.07.2010 made by the petitioner, expeditiously.
Upon
the above statement being made by the learned
advocate for the petitioner, the following order is passed:
Respondent
No.2 is directed to consider and decide representation dated
13.07.2010 made by the petitioner, in accordance with law, and within
a period of three months from the date of receipt of a copy of this
order.
It
is clarified that while passing this order, the Court has not entered
into the merits of the case.
The
petition is disposed of in the above terms.
Direct
Service of this order is permitted.
