J U D G M E N T
The petitioner is presently working as Mechanic Grade I in the
office of the Assistant Controller of Stationary, Kozhikode.
Petitioner’s home district is Kollam. Petitioner’s husband is afflicted
by a very rare decease to the eye known as Proliferative Diabetic
Retinopathy, as a result of which he had suffered loss of vision.
Consequently, he has to depend on his wife even for his day-to-day
activities. According to the petitioner, as per Ext. P4 Government
Order, the Government servants having such spouses are entitled to
transfer to the station of their choice. Therefore, the petitioner seeks
a transfer to Kollam. Seeking this relief, the petitioner has filed
Exts.P6 and P8 before the 1st respondent. The petitioner seeks a
direction to the 1st respondent to consider and pass orders on Exts.P6
ad P8 expeditiously.
Having heard the learned Government Pleader also, I dispose of
this writ petition with a direction to the 1st respondent to consider and
pass orders on Exts.P.6 and P8 as expeditiously as possible, at any
rate, within three months from the date of receipt of a copy of this
judgment, after affording an opportunity of being heard to the
petitioner. If the 1st respondent is inclined to concede to the request
of the petitioner, the petitioner shall be considered for
accommodation in one of the vacancies at Kollam which may arise on
31.3.2011, on account of retirement.
