In view of G.O.(Rt) No.239/2009/PD dated

18.9.2009 passed by the Government, this Writ Petition has

become infructuous. Accordingly, the Writ Petition is dismissed

without prejudice to the contentions of the petitioner and his

right to file fresh Writ Petition challenging the aforementioned

order of the Government, if so advised.
