                 W.P ( C) No.15600 of 2008
                     --------------------------
Dated this the 11th August, 2008

                       J U D G M E N T

I have heard Sri.B.Krishnan, the learned counsel

appearing for the petitioner, Smt.M.R. Sreelatha, the

learned Government Pleader appearing on notice for

respondents 1 and 3 and Sri.P.V.Kunhikrishnan, the

learned standing counsel appearing for the 2nd

respondent.

2. The petitioner is a pensioner. He retired from

service as Assistant Executive Engineer from the Calicut

Corporation on 31.5.2005 on attaining the age of

superannuation. The grievance voiced by the petitioner is

that though he has been paid pension and other terminal

benefits, the DCRG payable to him has not been disbursed

so far. When this writ petition came up for admission on

30.7.2008, the learned Government Pleader appearing on

behalf of the respondents 1 and 3 submitted that DCRG

has been sanctioned to the petitioner as per order dated

11.7.2008.

2

3. Today when the case was heard, the learned

standing counsel appearing for the 2nd respondent

submitted that there was no delay on the part of the said

respondent in forwarding the pension papers and that the

delay in disbursing the DCRG occurred at the hands of the

State Government. I have considered the submissions made

by the learned counsel on either side. In view of the fact

that there is no impediment in the disbursement of the

DCRG payable to the petitioner and as the Government

have admittedly passed an order on 11.7.2008, I dispose of

this writ petition with a direction to the respondents to

disburse the DCRG payable to the petitioner within a

period of two weeks from the date of receipt of a copy of

this judgment. The claim of the petitioner for interest due

to delayed payment of the DCRG is left open. He may work

out his remedies regarding his claim for interest in other

appropriate proceedings.
