                          JUDGMENT

The petitioner, who is a Junior Public Health Nurse,

working at Primary Health Centre, Karimannur, is aggrieved by

Ext.P3 order, by which, she has been transferred from

Karimannur to Primary Health Centre, Vathikudy.

2. Learned counsel for the petitioner submits that

under Ext.P2 preliminary order of transfer, the petitioner was

proposed to be posted at Primary Health Centre,

Karimkunnam. Apparently, when Ext.P3 order came to be

passed, the said proposal was given a goby. It is this order,

which has been challenged by the petitioner in this writ

petition.

3. Learned counsel for the petitioner submits that 5

places had been indicated as options by the petitioner in

Ext.P1. Though none of those were accepted when Ext.P2

order was passed, the petitioner did not challenge the same.

Now, the proposal under Ext.P2 itself has been given a goby.

It is further submitted that the petitioner’s husband is currently

stationed at the Village Office at Alakode. It is also contended

that as far as possible, the spouses may be posted in the same

station or in the nearby stations. She may have to travel a

distance of at least about 100 km per day if she has to work at

Vathikudy. In my view, it is a matter, which the petitioner

may, legitimately, bring to the notice of the Director of Health

Services. The Director of Health Services may also consider,

taking note of the personal reasons pleaded by the petitioner,

whether she could be accommodated in a nearer station.

4. If the petitioner files a representation in this

behalf within a period of one week from today, it shall be

considered within two weeks thereafter by the Director of

Health Services. If any other person is affected by reason of

the petitioner’s claim being accepted, such person shall also

be heard along with the petitioner by the Director of Health

Services, before orders are passed on the petitioner’s

representation.

Writ petition is disposed of in the above terms.
