              Dated this, the 10th day of February, 2011.

                            J U D G M E N T

The petitioner is an Excise Inspector in the Department of

Excise of the Government of Kerala. He aspires for promotion to the

post of Excise Circle Inspector, which has been denied to him on the

ground that the petitioner has not passed the obligatory departmental

test. According to the petitioner, the petitioner being a member of a

scheduled caste, the petitioner is entitled to be promoted under Rule

13A(i)(a) of the Kerala State and Subordinate Service Rules. Despite

the same, the juniors of the petitioner have been promoted, is the

contention of the petitioner. The petitioner has filed Ext. P3

representation in respect of the same. The petitioner presently

confines his relief for a direction to the respondent to consider and

pass orders on Ext. P3 expeditiously.

Having heard the learned Government Pleader also, I dispose of

this writ petition with a direction to the respondent to consider and

pass orders on Ext. P3 as expeditiously as possible, at any rate, within

two months from the date of receipt of a copy of this judgment, after

affording an opportunity of being heard to the petitioner.
