                           J U D G M E N T

Petitioner is occupying quarter No. F-10 in the police family

quarters, Thiruvananthapuram. Ext.P1 order was passed by the 3rd

respondent ordering his eviction. Implementing Ext.P1, the 4th

respondent issued Ext.P2 notice. Thereupon, the petitioner

submitted Exts.P3 and P4 representations before the 4th respondent

and 2nd respondent respectively. By Ext.P5, the 2nd respondent called

him for a hearing and according to the petitioner a hearing was

granted. When urged his contentions in the matter. According to the

counsel, final orders have not been passed on Ext.P5 so far and in

the meanwhile Ext.P6 notice has been issued requiring his

immediate eviction. It is in this circumstances the writ petition is

filed.

2. From the facts stated above it is seen that, according to

the petitioner, the appeal filed by him before the 2nd respondent

evidenced by Ext.P4 is pending and orders have not been passed so

far. It is at this stage that he is sought to be evicted from the

quarters.

3. In my view in the circumstances as noticed above, what is

required to be done is that the 2nd respondent should consider

Ext.P4 and pass final orders, deferring coercive action against the

petitioner.

Therefore, I dispose of this writ petition directing the 2nd

respondent to pass orders on Ext.P4. This shall be done as

expeditiously as possible and at any rate within 4 weeks from the

date of production of a copy of the judgment. It is directed that in

the meanwhile further proceedings pursuant to Exts.P2 and P6 will

be kept in abeyance .

Petitioner shall produce a copy of the judgment along with a

copy of this writ petition before the 2nd respondent for compliance.
