                            J U D G M E N T

Kurian Joseph, J.

Appellant/petitioner approached this court aggrieved by

the denial of promotion to the post of Middle Management Grade II. It

is the case of the petitioner that he is entitled to be considered for

promotion in the light of Ext.P3 memorandum issued by the

Government. The learned Single Judge directed the Bank to consider

the case of the petitioner in the light of Ext.P3 memorandum. It is

seen that the bank has since considered the matter and passed Ext.R1

(g) order. If the petitioner is aggrieved, it is for him to pursue the

matter in appropriate proceedings challenging Ext.R1(g). Without

prejudice to such liberty, this appeal is dismissed. It is made clear

that we have not adverted to the various other contentions taken by

the parties, in view of the intervening development referred to above,

and hence all the contentions are left open.
