J U D G M E N T
Petitioners, who are Last Grade Servants in the Printing
Department, claimed promotion to the post of Printer Grade II. That
was rejected by Ext.P12 order dated 17/05/2010 on the ground that
the post of Printer Grade II was a vanishing category.
2. Referring to Ext.P13 Government Order dated
15/03/2010, the learned counsel for the petitioners submits that
those in the feeder category to Printer Grade II posts are eligible to
be considered for promotion to Grade I. It is stated that it was
without taking into account Ext.P13 Government Order that Ext.12
order was passed by the Director.
3. However, a reading of Ext.P12 order shows that the claim
of the petitioners for promotion as Printer Grade – II was considered
by the Director in the light of Ext.P13 Government Order and it was
held that as the said category has been declared as a vanishing
category, promotion cannot be granted. This view cannot be said to

be erroneous.
However, if as stated by the petitioners, there is a possibility
for the Director to consider them for promotion to Grade I, it is
made clear that it will be open to the petitioners to file a fresh
representation to the Director, in which event, the same will be
considered and orders thereon will be passed, duly adverting to
Ext.P13 Government Order. If a representation is received from the
petitioners within two weeks from today, the same shall be dealt
with by the Director (2nd respondent) as expeditiously as possible, at
any rate, within six weeks thereafter.
This writ petition is disposed of as above.
