The petitioners are sureties for a loan availed by one
Mr.Manikantan. He had availed a loan of Rs.50,000/- in
the year 2000 from the Venjaramoodu Branch of the
Thiruvananthapuram District Co-operative Bank. At
present, the loan amount has accumulated to
Rs.1,36,000/-. Since the principal debtor has defaulted
repayment of the loan, recoveries are being effected from
the salaries of the petitioners. Already, an amount of
Rs.12,000/- has been recovered from the petitioners. The
petitioners therefore want to close the loan account by
paying off the entire amount. For the purpose, they have
submitted Exts.P1 and P2 representations before the third
respondent. The petitioners claim that they are entitled to
the benefits of Circular No.2/2010 dated 14.1.2010 of the
Registrar of Co-operative Societies, Thiruvananthapuram.
2. Adv.K.G.Radhakrishnan who appears for the bank
submits that Exts.P1 and P2 letters are dated 24.7.2010
and that there has been no delay in the consideration of

the representation. He assures that the representations
would be considered in the light of the circular relied on
by the petitioner and appropriate orders would be passed
thereon, without delay.
3. In the above circumstances, this writ petition is
disposed of directing the second respondent to consider
the representations of the petitioners evidenced herein by
Exts.P1 and P2 in accordance with law and to pass
appropriate orders thereon, as expeditiously as possible
and at any rate within a period of two weeks from the date
of receipt of a copy of this judgment in the light of Circular
No.2/10 dated 14.1.2010 of the Registrar of Co-operative
Societies, Thiruvananthapuram.
