                                          O R D E R

Application for anticipatory bail. The petitioner apprehends arrest as

an accused in Crime No. 363 of 2007 of Angamali Police Station. The

defacto complainant is none other than the wife of the petitioner. The

learned Prosecutor submits that there is no question of issuing any

direction under Section 438 Cr.P.C. as all the offences alleged in the said

crime are bailable offences. The petitioner can appear before the

Investigating Officer and claim to be released on bail even without any

directions of this Court, it is submitted.

2. That submission of the learned Prosecutor is taken note of and

recorded. In the light of the above submissions, the apprehension

entertained by the petitioner that he may be arrested on the allegation of

having committed non-bailable offence is found to be without any merit or

basis.

3. This application is hence dismissed with the above observations.
