Heard learned counsel for the petitioner, Sri Vinay Shanker learned counsel
who has accepted notice on behalf of opposite party No.3., learned standing
counsel and perused record.
On account of default of payment of dues, the recovery proceedings, have
been initiated against the petitioner. The submission of the petitioner’s
counsel is that the petitioner is ready to pay the entire dues in instalments.
Learned counsel for the respondent Bank has no objection in case the entire
dues are paid.
Keeping in view the facts and circumstances, the respondents are directed to
provide the statement of account to the petitioner within 15 days from the date
of issuance of a certified copy of this order. Thereafter, the petitioner shall
pay the entire dues in three equal quarterly instalments to the respondent
Bank. The first instalment shall fall due in first week of March, 2010. In the
event of default of payment of dues, it shall be open to respondents to recover
the same in accordance with law.
Subject to above, the writ petition is finally disposed of.
