ORAL
ORDER

(Per
: HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)

The
writ petition in public interest was instituted suo motu on a
complaint that students of Deaf-Dumb Vidyalaya, Godhra, District
Panchmahal, are being harassed. The Court noticed the allegation of
sexual harassment to girl students and the fact that no action was
taken even by lodging First Information Report. In this background,
the Court passed different interim orders from time to time.
Pursuant to the Court’s direction ultimately complaint was lodged and
two accused persons were arrested on 03.12.2009 and later enlarged on
bail.

Today
when the matter has been taken up, Ms. Trusha Patel, learned A.G.P.,
produced a letter dated 11.01.2010 written by Inspector of Police,
Godhra `A’ Division Police Station and submitted that after
investigation of the case charge sheet has already been submitted
against the accused persons. The respondents have also taken steps
against the erring officers.

Taking
into consideration the facts aforesaid, we are of the view that no
further monitoring is required in the present case, which stands
disposed of with a direction to the respondents to pursue the case
pending before the Court below, and if so required, they may initiate
departmental proceedings against the erring officers.

Special
Civil Application stands disposed of with the aforesaid observations.
No costs.
