Heard counsel for petitioner and learned Public Prosecutor.

2. Petitioner challenged the condition imposed by the

learned Additional Chief Judicial Magistrate vide order dated

10.9.08 on C.M.P.No.4973/2008 in this Court in

Crl.M.C.4063/2008. This Court as per order dated 31.10.2008

while disposing of Crl.M.C.4063/08 directed that the condition

imposed by the learned Additional Chief Judicial Magistrate that

sureties must produce solvency certificates shall not be enforced

by the learned Additional Chief Judicial Magistrate “now” and

further directed that it is sufficient that if the sureties are

otherwise found acceptable, learned Additional chief Judicial

Magistrate granted the petitioner and the sureties further time of

45 days from the date of release of the petitioner from custody,

to produce solvency certificates as directed. Now, the prayer is

to extend the time for production of the solvency certificate by

another two months. It is stated in the petition that petitioner

was in judicial custody for about six months, his business was

closed down and that he was unable to make up the solvency

certificate within the time granted. Hence, he requests to extend

the time.

3. I heard the learned public prosecutor also on the

matter.

4. In the facts and circumstances of the case and

considering the request made by the petitioner, I am inclined to

extend the time by 45 (forty five) days from today. It is made

clear that no further extension will be granted.

Crl.M.C. is disposed of accordingly.
