Heard learned counsel for the petitioner and learned Standing Counsel for the
State-respondents.
Petitioner is aggrieved by the order passed by the District Basic Education
Officer/Secretary Examination Committee of Block Resource
Coordinator/Assistant Block Resource Coordinator, Sant Ravi Das Nagar,
Bhadohi, wherein a decision has been taken that persons who have completed
two years of employment as Block Resource Coordinator/Assistant Block
Resource Coordinator, cannot be considered for fresh appointment in terms of
the Government Order dated 29th June, 2002. It is against this part of the
order that the present writ petition has been filed alleging therein that the
petitioner has not worked as Block Resource Coordinator/Assistant Block
Resource Coordinator within the meaning of Government Order dated 29th
June, 2002 and therefore, his claim cannot be excluded.
It is not necessary for the Court to enter into the issue at this stage, inasmuch
as if the claim of the petitioner is not barred by Government Order dated 29th
June, 2002, there is no reason for the petitioner to apprehend that his
candidature for appointment as Block Resource Coordinator/Assistant Block
Resource Coordinator will be excluded. The present writ petition is therefore,
dismissed at this stage. However, if any action adverse is taken against the
petitioner, he will be at liberty to seek his remedy in accordance with law.
