Heard
learned advocate Mr. G.M. Joshi appearing on behalf of petitioner.

I
have considered detailed submissions made by both learned advocates
appearing on behalf of respective parties and I have also perused all
documents which are annexed to present petition by petitioner.
According to my opinion, whatever grievance voiced in present
petition, if petitioner may approach the highest authority of
department means Secretary, Finance Department, Sachivalaya,
Gandhiangar who can look into matter and consider grievance of
present petition and pass appropriate reasoned order which will meet
ends of justice between both parties.

Therefore,
let petitioner may make detailed representation to Secretary, Finance
Department, Sachivalaya, Gandhiangar in respect of his grievance
voiced in present petition within a period of one week from date of
receiving copy of present order.

As
and when Secretary, Finance Department, Sachivalaya, Gandhiangar
received such representation from petitioner, it is directed to
Secretary, Finance Department, Sachivalaya, Gandhiangar to examine
grievances of present petition independently and also to consider his
difficulties which have been mentioned in representation and
thereafter to pass appropriate reasoned order in accordance with law
within a period of two months from date of receiving such
representation from petitioner and communicate such decision to
petitioner immediately.

In
view of above observation and direction, present petition is disposed
of by this Court without expressing any opinion on merits.

However,
in case, if ultimate decision is adverse to petitioner, then, it is
open for petitioner to file appropriate proceedings before
appropriate forum in accordance with law.

Direct
service is permitted.
