Heard,
Mr. P.A.Bhatt, learned advocate for the applicant and Mr.
U.A.Trivedi, learned Additional Public Prosecutor at length and in
great detail. Considering the avernments made in the application and
submissions canvassed by the learned Counsel for both the parties,
the prayer as set out in paragraph-9(A) is granted.
The
applicant is permitted to leave India from 2/3/2010 to 2/5/2010.
Passport, which is deposited by the applicant be given to him. The
applicant shall re-deposit the passport on his return to India from
United Kingdom as well as U.S.A. on or before 4/5/2010. However, it
is made clear that applicant shall deposit an amount of Rs. 50,000/-
before the Court of Chief Judicial Magistrate, Surat within a week
from today and the same shall be refunded to the applicant on his
surrendering the passport after his return.
Rule
is made absolute to the aforesaid extent. Direct service is
permitted.
