       This is in continuation of this Commission's Decision dated
9.12.2009 wherein Shri G.C. Suman, Dy Director (LM) (SEZ), was
directed to provide certain information to the appellant, as indicated in the
Commission's decision dated 15.4.2009. The time given was two months.
However, during the hearing held today dated 8.3.2010, it transpired that
the requisite information has not been provided to the appellant. Besides,
Shri G.C. Suman, Dy Director (LM) (SEZ), has not appeared before the
Commission despite notice. DDA is represented by Shri Raj Kumar,
Patwari. The appellant, who is present before the Commission pleads for
monetary compensation for detriment suffered by him due to denial of
information. It is his plea that the matter was heard on 27.2.2009,
6.4.2009, 15.4.2009 and 9.12.2009 but all these hearings have gone futile
as no information has been provided to him so far, despite the
Commission's clear orders.
                                 DECISION
2.     It appears to us that neither former Dy Director (LM) (SEZ) nor the
present incumbent appear to have taken the decision of the Commission
seriously. As rightly pleaded by the appellant this has caused him
detriment in terms of section 19 (8) (b) of the RTI Act. In view of this, an
interim compensation of Rs 5000/- is awarded to appellant Shri Kanhaiya
Lal r/o A-88, Bhumihin Camp, Govindpuri, Kalkaji, New Delhi, in 04
weeks time. The compensation will be remitted by Secretary, DDA, by a
demand draft/cheque in 04 weeks time under intimation to this
Commission. The Secretary, however, will have the discretion to deduct
this amount from the salary of the erring official.

3.     The matter is adjourned to 26.4.2010 at 1130 hrs. Notice may be
issued to Shri G.C. Suman, Dy Director (LM) (SEZ) to comply with the
order of the Commission in the intervening period, failing which the
Commission will be constrained to proceed against him u/s 20 (1) of the
RTI Act.
