This
Court on 20.07.2008, had passed the following order :-

?SLearned Advocate for
the appellant will take appropriate action, within four weeks from
today, for serving unserved respondent, failing which the appeal
shall stand dismissed for non-prosecution. SO to 21st
August, 2007.??

2. Today,
when the matter is called out for hearing, it appears that no action
has been taken by the learned counsel for the appellant to bring the
legal heirs on record. In view of the sick note of the learned
counsel for the appellant, SO to 23.07.2008. It is made clear that
before the next date the learned counsel for the appellant shall take
appropriate action in the matter.
