3 20-09-2011 Heard learned counsel for the petitioner as well

as learned Additional Public Prosecutor for the state.

Petitioner, being the husband of the deceased,

is languishing in jail custody in a case registered under

Sections-302, 201/34 of the Indian Penal Code.

It would appear from perusal of the first

information report that on the basis of farebeyan of

Chowkidar, Maner P.S. Case No. 289 of 2009 under

Sections-302, 201/34 of the Indian Penal Code was

registered against unknown when dead body of a female,

kept in a gunny bag, was recovered. Subsequently, in

course of investigation, it surfaced that the deceased was

wife of petitioner and it also came to light that the

deceased used to quarrel with her in-laws including the

petitioner and she was in habit of leaving her matrimonial

home without informing to her in-laws as well as her

husband.

Learned counsel for the petitioner points out

that having more or less similar allegation, co-accused,

namely, Shankar Ray and Shailesh Kumar @ Shailesh

Ray have already been granted privilege of bail by

another bench of this court vide order dated 29-06-2010

passed in Cr. Misc. No. 21388 of 2010.

Accordingly, the petitioner, namely, Kapil Ray is

directed to be released on bail on furnishing bail bond of

Rs 10,000/- (ten thousand) with two sureties of the like

amount each in connection with Sessions Trial No. 848 of

2011 arising out of Maner P.S. Case No. 289 of 2009 to

the satisfaction of Additional Sessions Judge-II, Patna.
