ORAL ORDER

Rule.

Mr.D.C.Sejpal, learned Additional Public Prosecutor waives service
of notice of Rule for respondent State. Having regard to the facts
and circumstances of the case, this application is taken up for
final hearing today.

Considering
the jail remarks and the order passed by the Inspector General of
Prison, Gujarat State, Ahmedabad dated 19.03.2010, applicant
absconded for a period of 333 days. Considering the above conduct of
the applicant, in my view, he is not entitled to be granted
discretionary relief as prayed for in the application.

For
the forgoing reasons, application is devoid of merits and it is
hereby rejected. Rule is discharged.
